Why You Need an Estate Plan

Planning for the future isn’t just about protecting assets—it’s about ensuring your wishes are honored and your loved ones are cared for after you’re gone. Without an estate plan in place, Ohio’s laws will dictate how your assets are distributed, often leading to unintended consequences. In Ohio, your assets are subject to the one-size-fits-all statute of descent and distribution unless you make other arrangements.

Without other planning, your assets are distributed to blood relatives within your immediate family upon your death. For some individuals, this plan of distribution aligns with their personal values. However, this process still leaves your family members to go through the probate process to gain possession and control over your assets. This can be a long and costly court process and can be avoided with proper estate planning.

For residents who wish to leave their estate to someone other than immediate blood relatives, this default plan can be particularly problematic and result in unintended consequences at their death. The default plan does not provide for stepchildren, close family friends, charities, and others not related by blood. Additionally, the default plan may result in your money going to estranged family members or others you may not intend to benefit from your estate.

There is much about death that we can’t control. While there are many uncertainties about death, we can control our legacy and make our final wishes known through an estate plan.

A basic estate plan can fit your budget and allow you to rest easy knowing your money and property will end up where you want them to go.
